Where we help

One old rule decides most cases here

D.C., Maryland, and Virginia still apply contributory negligence: if you are found even slightly at fault, you can recover nothing. Cases are won or lost on the evidence gathered early, and on knowing each jurisdiction's deadlines.

Washington, D.C.

Pedestrians and cyclists hit by vehicles keep their claims unless their fault exceeds the drivers' combined fault (D.C. Code § 50-2204.52).

Maryland

Contributory negligence applies in full, with three years to file a lawsuit (Md. Code, Cts. & Jud. Proc. § 5-101).

Virginia

Contributory negligence applies in full, and the deadline is shorter: two years to file (Va. Code § 8.01-243(A)).
